The most important thing to understand is the question of whether or not it is a crime for a graffiti artist to make a statement about a real or imagined situation, and then to then spray-paint the words he had written over that same real situation. If you don’t have a lot of respect for someone who does this, you may say these words “a lot of bad things can happen to you if you don’t do this kind of stuff,” or you might say “Well, this is bad. That’s stupid…” Some people say, “well, maybe it should be a crime… what if that person is actually injured by the words written on their walls? What about the other people who come at that person and try to hurt them?” But that is not the way it should work. It’s the way it should work. And it should not work because we all have the right to say what we want. It should not work because people’s personal beliefs about what is or is not acceptable are not protected by the First Amendment… or by any human law or rule.

When I said ‘people’s beliefs about what is or is not acceptable’ I wasn’t just saying it’s bad to say it. I was saying that for a lot of people who claim that they agree with my point of view – that say graffiti is a symbol of an entire person’s wrongs – graffiti is bad. That graffiti is bad because graffiti is a bad way of criticizing the people in the culture it represents. Let’s take a simple example – what do people who think graffiti is something wrong really believe about racism? It’s not something that I’m concerned about. I would argue you could think that it’s bad to be racist, but it’s not that I personally find graffiti to be an important thing on the whole or that I think that it’s a valid expression of those things (a few people may see something different and say things like, “yeah, it’s bad, let’s stop.”).

I just said that people’s beliefs about what is or is not acceptable are not protected by the First Amendment… or by any human law or rule. In fact, I said that the reason a few people think it’s a crime to hate graffiti is because the First Amendment doesn’t protect us from the idea that the First Amendment doesn’t protect them from the idea that they might actually be offended by those who find graffiti offensive, because in their minds it’s a crime to express an opinion through their words.
